L. A. D. C. A. V. D. Tenant D.R.A.T.A.S. (T. 'L.') applied for an order requiring D. C. A. V. D. (T. 'Tenants') to pay T. rent that T. Tenants owe. This application was heard by videoconference on March 14, 2023. Only T. L.’s representative, Jonathan Day, attended T. hearing. T. L. A. T. Tenant attended T. hearing. As of 2:00 p.m., T. Tenants were not present or represented at T. hearing although properly served with notice of this hearing by T. LTB. There was no record of a request to adjourn T. hearing. As a result, T. hearing proceeded with only T. L.'s evidence. Determinations: 1. T. Tenants were in possession of T. rental unit on T. date T. application was filed. 2. T. Tenants vacated T. rental unit on October 9, 2022. T. tenancy was not lawfully terminated in accordance with a notice of termination, LTB order or agreement to terminate T. tenancy. Therefore, T. Tenants’ obligation to pay rent ends on October 31, 2022. 3. T. Tenants did not pay T. total rent they were required to pay for T. period from May 1, 2022 to October 31, 2022. 4. T. lawful rent is $1,448.40. It is due on T. 1st day of each month. 5. T. Tenants have not made any payments since T. application was filed. 6. T. rent arrears A. daily compensation owing to October 31, 2022 are $5,790.40 7. T. T. Tenants shall pay to T. L. $5,991.40. This amount includes rent arrears owing up to October 31, 2022 A. T. cost of T. application. 2. If T. Tenants do not pay T. L. T. full amount owing on or before April 9, 2023, T. Tenants will start to owe interest. This will be simple interest calculated from April 10, 2023 at 5.00% annually on T. balance outstanding.
