ON N5W1H5 Between: L.M.C.H. Landlord And Brian Concannon Tenant Review Order L.M.C.H. (the 'Landlord') applied for an order to terminate the tenancy and evict Brian Concannon (the 'Tenant') because the Tenant did not pay the rent that the Tenant owes. This application was resolved by order LTB-L-067442-22 issued on September 2, 2021. On October 21, 2021, the Tenant requested a review of the order and that the order be stayed until the request to review the order is resolved. The Tenant alleged that they were not reasonably able to participate in the proceeding. On October 22, 2021, interim order LTB-L-067442-22-RV-IN was issued, staying the order issued on September 2, 2021. This application was heard by videoconference on April 18, 2023. Only the Landlord's Legal Representative, C. Burgess, attended the hearing. As of 9:51 a.m., the Tenant was not present or represented at the hearing although properly served with notice of this hearing by the Board. Preliminary Issue: At the hearing, the Landlord's Legal Representative unsuccessfully tried to reach the Tenant by phone. He was previously informed that the legal clinic no longer represents the Tenant. Determinations:  1. The request to review order LTB-L-067442-22 issued on September 2, 2021, is denied. The order is confirmed and remains unchanged. 2. The interim order issued on October 22, 2021, is cancelled.
