CAPREIT LIMITED PARTNERSHIP (the 'Landlord') applied for an order to terminate the tenancy
A. evict C.B.A.J.F. (the 'Tenants') because the Tenants did not pay the
rent that the Tenants owe.
This application was heard by videoconference on June 5, 2023.
Only the Landlord's Legal Representative, Crystal Hosannah, attended the hearing.
As of 1:20 p.m., the Tenants were not present or represented at the hearing although properly
served with notice of this hearing by the LTB. There was no record of a request to adjourn the
hearing. As a result, the hearing proceeded with only the Landlord's evidence.
Determinations:
1. The Landlord’s Legal Representative advised that the Tenants paid the Landlord prior to
the hearing date all rent that was in arrears, any additional rent that would have been due
under the tenancy agreement up to May 31, 2023, A. the filing fee for this application,
2. The Landlord's application relating to eviction of the Tenants based on arrears of rent is
discontinued.
3. As payment in full was made, there is no reasonable cause of action to proceed on the
Landlord's application for compensation A. for arrears, A. it is therefore dismissed.
