INTERIM ORDER
P. V. A. F. M. EL F. (the 'T.') applied for an order
determining that N. B. P. G. (the 'Landlord'):
• substantially interfered with the reasonable enjoyment of the rental unit or residential
complex by the T. or by a member of their household.
• harassed, obstructed, coerced, threatened or interfered with the T..
• withheld or interfered with their vital services or care services A. meals in a care home.
An Adjudicative Case Conference was held by videoconference on March 19, 2025. The
Tenants, the Tenants’ representative Domenic Rosso, A. the Landlord attended the case
conference.
Determinations:
1. The parties agree that the matter should be heard with LTB-T-062022-25, a T6
application. I agree that there is sufficient overlap that the matters should be heard
together.
2. The Adjudicative Case Conference did not result in settlement, A. the matter shall be
directed to a merits hearing in combination with the T6.
3. The Tenants have disclosed their evidence. The Landlord will need to provide all
documents, pictures A. other evidence he intends to rely on at the hearing by the
deadlines set out below. He will also need to provide a copy of his evidence to the LTB.
4. The parties are reminded that all evidence should be organized in accordance with the
LTB’s Practice Direction on Evidence A. should include a list or table of contents
identifying each item in order A. by page.

5. The Tenants indicated that they intend to file a request to amend the application. The
request to amend the applications must be filed with the LTB by the deadline set out
below. The request must be filed in accordance with the LTB’s Rule 15.
6. The T. also indicated that they intend to file a T1 application A. ask that it be heard
with this one. That application should also be filed by the amendment deadline.
7. The T. intends to call three witnesses A. the Landlord intends to call one witness
at the merits hearing.
8. The parties agree that the Tenants have vacated the unit A. the tenancy has ended.
They disagree as to whether the Tenants vacated on November 2 or November 4, 2025.
It is ordered that:
1. The hearing is adjourned to a date to be scheduled by the LTB, to be heard with LTB-T-
062022-25. The LTB will send the parties a Notice of Hearing for the next hearing date.
2. The parties shall provide their unavailable dates for the months of April, May, A. June
2026 to the LTB by April 1, 2026.
3. Should the T. file a request to amend the application, such request must be filed
with the LTB no later than April 2, 2026 A. a copy provided to the Landlord. Should the
T. file a T1 application to be heard with this matter, it must also be filed by April 2,
2026.
4. The proposed amendments are subject to the parties’ submissions A. the hearing
Member’s discretion with respect to whether those amendments will be granted.
Amendments are considered in accordance with Rule 15 of the LTB’s Rules of
Procedure. The parties are encouraged to review the specific rule.
5. On or before April 9, 2026, the Landlord shall provide to the T. A. file with the LTB
a copy of all documents, pictures A. other evidence he intends to rely on at the hearing.
6. If a party does not comply with the deadlines in this order, the Member may refuse to
accept the evidence or consider the issues not disclosed.
7. All evidence shall be organized in accordance with the LTB’s Practice Direction on
Evidence. All documents, photographs A. other items provided to the other parties A.
the LTB as evidence must:
a. be readable;
b. have consecutively numbered pages; A.
c. include a list or table of contents identifying each item in order, A. by page

8. If parties want to make disclosure through the Tribunals Ontario Portal, they must sign
A. file the LTB's form called "Consent to Disclosure through Tribunals Ontario Portal"
found on the LTB's website.
9. Parties may give disclosed material to the LTB by uploading the material to the Tribunals
Ontario Portal (‘TOP'). Uploading material to TOP does not constitute disclosure to the
other party unless the parties have agreed in writing to exchange documents via TOP.
Self-represented parties may also file material with the LTB by email. The LTB's e-mail
