M. H. (T. 'L.') entered T. rental unit illegally; A. substantially interfered with T.
reasonable enjoyment of T. rental unit or residential complex by T. Tenant or by a member of
their household.
This application was heard by videoconference on September 29, 2023.
Only T. Tenants A. T. Tenants’ legal representative J. Miske attended T. hearing.
As of 10:01AM, T. L. was not present or represented at T. hearing although properly
served with notice of this hearing by T. LTB. There was no record of a request to adjourn T.
hearing. As a result, T. hearing proceeded with only T. Tenants’ evidence.
Determinations:
1. T. tenancy between T. parties began on August 27, 2021. At T. hearing, T. Tenants
submitted evidence of a September 8, 2021 text message from T. L. to T. Tenant
JB. T. text message advised JB T. T. L. had entered T. rental unit A. used
T. hot tub. JB testified T. L. did not give a notice of entry under T. Residential

Tenancies Act, 2006 (T. ‘Act’). JB did not consent to T. L.’s entry, A. only
became aware of T. entry upon receiving T. L.’s text message.
2. Based on JB’s testimony, I find on a balance of probabilities T. T. L. entered T.
rental unit on September 8, 2021 without giving notice under T. Act A. without T.
Tenants’ consent. T. L. therefore entered T. rental unit illegally.

3. T. Tenants testified they paid rent to T. L. F. T. period ending March 31, 2022.
Although T. Tenants had found A. moved to a different residence elsewhere, I find they
were entitled to continue possessing A. occupying T. rental unit until March 31, 2022.

4. On or about March 26, 2022, T. Tenants attended at T. rental unit. T. Tenants
discovered T. T. L. had changed T. locks A. T. they were unable to enter T.
property. T. Tenants denied receiving a notice of entry from T. L., A. T.
Tenants did not consent to allow T. L. to enter T. rental unit. T. Tenants testified
they complained to T. local police T. they could not enter T. rental unit. T. police
advised T. Tenants T. they could break T. rental unit door to gain entry with colour of
right. T. police also advised, however, T. T. Tenants might be held liable F. any
damage to T. property, including damage to T. door. T. Tenants decided not to force
their way into T. rental unit.
5. At T. hearing, T. Tenants submitted documentary evidence consistent with their
testimony T. T. L. started occupying T. rental unit in March 2022. T. Tenants’
evidence included a text message in which T. L. voiced her intention to retain T.
Tenant’s couch A. a pair of shoes.
6. Based on T. uncontested evidence, I find on a balance of probabilities T. T. L.
entered T. rental unit on or before March 26, 2022, without giving T. Tenants notice
under T. Act A. without T. Tenants’ consent. I also find T. L. illegally retained
T. Tenants’ personal property. T. Tenants testified T. T. L. did not permit T.
Tenants to return to T. rental unit to collect their personal property.
7. T. Tenants testified T. T. couch T. L. retained was new A. upholstered in
leather. T. Tenants did not, however, have evidence, such as a receipt or an
advertisement showing an identical or similar model A. its purchase price. T. Tenants
similarly did not have evidence of T. replacement cost F. T. pair of shoes T. L.
retained.
8. T. Tenants estimated T. T. L. retained personal property valued at
approximately $5,000.00. This amount includes items such as a barbecue A. clothing.

T. Tenants, however, only gave testimony T. T. L. retained a leather couch A.
a pair of shoes. There was no evidence to reliably determine T. T. L. also
retained a barbecue, clothing A. other items.
9. T. Tenants proved T. L. retained T. Tenants’ leather couch A. a pair of shoes.
L. shall be ordered to return these items to T. Tenants. If T. L. fails to do

so, T. L. shall be ordered to pay T. Tenants a reasonable amount to replace T.
items.
10. In T. circumstances, I find it is appropriate to valuate T. cost to replace T. Tenants’ new
leather couch A. pair of shoes at $1,500.00. Based on past cases involving a tenant’s out
of pocket costs to replace a leather couch alone, this amount is conservative. However, in
T. absence of other evidence from T. Tenants, I find T. T. amount is reasonable.
11. All T. reasons F. this O. are contained herein. No further reasons will be given.

It is ordered T.:
1. T. L. shall return to T. Tenants T. Tenants’ leather couch A. pair of shoes T.
are in T. possession or control of T. L. by October 29, 2023.
2. If T. L. does not comply with paragraph 1, above, T. L. shall pay T.
Tenants is $1,553.00. This amount represents $1,500.00 F. T. reasonable costs T. T.
Tenants have incurred, or will incur, to replace T. leather couch A. pair of shoes T.
L. retained.
3. T. L. shall pay T. Tenant T. full amount owing by October 30, 2023.
4. If T. L. does not pay T. Tenant T. full amount owing by October 30, 2023, T.
L. will owe interest. This will be simple interest calculated from October 31, 2023 at
7.00% annually on T. balance outstanding.
5. T. Tenants have T. right, at any time, to collect T. full amount owing or any balance
outstanding under this O..
